Terms of Service

These Terms of Service ("Terms") govern your use of MemorySpark ("the app," "we," "us"), a flashcard and language-learning app published by Idea Solutions. By creating an account or using the app, you agree to these Terms. If you don't agree, please don't use the app.

Accounts

• You must be at least 13 years old to create an account.
• You're responsible for keeping your account credentials secure and for all activity under your account.
• You can sign up with email/password, Google, or Apple. However you sign up, the email associated with your account is how we identify it.

Subscriptions, credits, and billing

Subscriptions

• MemorySpark offers a free tier and paid subscription tiers (Premium and Atelier), billed monthly or annually through the Apple App Store or Google Play.
• Subscriptions renew automatically at the price you agreed to, unless cancelled at least 24 hours before the renewal date. Manage or cancel your subscription through your Apple ID or Google Play account settings — we can't cancel it for you from within the app.
• If we change subscription pricing, we'll give notice before it takes effect for existing subscribers, as required by the applicable app store's policies.

AI-image credits

• Paid subscriptions include a monthly or annual allotment of credits for generating AI images. This allotment resets — it does not carry over — at each renewal.
• Credits purchased separately as one-off packs do not expire and are not affected by subscription renewals.
• Credits have no cash value, cannot be transferred between accounts, and are not redeemable for money.

Refunds

All purchases are processed by the Apple App Store or Google Play, and refunds are subject to their respective policies — we do not process refunds directly and generally cannot override a store's refund decision. We do actively monitor for patterns consistent with abusing the refund process (for example, exhausting a large credit grant immediately before requesting a refund for it), and may limit or suspend an account's access to paid features where that pattern appears, independent of whatever the store decides about the refund itself.

Acceptable use

You agree not to:

• Use the AI image generation, translation, or other AI-assisted features to create or request content that is illegal, infringing, or that violates our AI providers' own usage policies (including, but not limited to, OpenAI's usage policies)
• Access the app's servers or Cloud Functions through any means other than the official app — including scripts, bots, or automated tools — or attempt to bypass rate limits, credit checks, or other technical safeguards
• Reverse engineer, decompile, or attempt to extract the source code of the app, except where applicable law gives you the right to do so
• Share your account with others, or use the app to resell or redistribute generated content or app access as a commercial service
• Interfere with the app's normal operation or attempt to gain unauthorized access to other users' data

We may suspend or terminate accounts that violate these terms, including automated enforcement of usage limits designed to prevent abuse (for example, a temporary hold on image generation if usage patterns suggest abuse rather than normal use).

AI-generated content

• Images, translations, and other content generated through the app's AI features are produced by third-party AI models (currently including OpenAI) and may be inaccurate, low-quality, or occasionally inappropriate despite filtering. Review generated content before relying on it, especially translations used for actual language learning.
• Subject to the underlying AI providers' own terms, you may use images you generate through the app for your personal flashcards and related personal use. We make no guarantee of exclusive ownership or copyright protection over AI-generated content, as the legal status of AI-generated works varies by jurisdiction and is still evolving.

Your content

You own the flashcards, decks, and other content you create in the app. By using the app, you grant us the license needed to store, process, and display that content back to you as part of providing the service. We don't claim ownership of your content and don't use it to train AI models.

Our content and intellectual property

The app itself — its design, code, branding, and any pre-built decks or content we provide — is owned by Idea Solutions or its licensors and is protected by copyright and other intellectual property laws. These Terms don't grant you any rights to our trademarks or branding.

Disclaimers

The app is provided "as is," without warranties of any kind, express or implied. We don't guarantee the app will be uninterrupted, error-free, or that AI-generated content will always be accurate or appropriate. Language-learning content, including AI-assisted translations, should not be relied on as the sole source for anything safety-critical (e.g., medical, legal, or emergency communication).

Limitation of liability

To the maximum extent permitted by law, Idea Solutions is not liable for any indirect, incidental, or consequential damages arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us in the 12 months before the claim arose.

Termination

You can stop using the app and delete your account at any time from Account settings. We may suspend or terminate your access if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law. Deleting your account does not automatically cancel an active subscription — cancel that separately through Apple or Google.

Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date above when we do; continuing to use the app after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. If you are a consumer resident in Quebec, nothing in these Terms limits any right you have under Quebec's Consumer Protection Act that cannot be waived by agreement.
